General Terms and Conditions for Five Five Out

Article 1 – Definitions 1.1. In these general terms and conditions, the following definitions apply:

• “Five Five Out”: the foundation Five Five Out, located in The Netherlands, registered with the Chamber of Commerce under registration number 82676666.
• “Customer”: the natural person or legal entity entering into an agreement with Five Five Out.
• “Agreement”: any agreement between Five Five Out and the Customer, including any amendments and supplements thereto.
• “Website”: the website of Five Five Out, accessible at [https://fivefiveout.nl].

Article 2 – Applicability

• 2.1. These general terms and conditions apply to all offers, quotations, agreements, and deliveries made by Five Five Out.

Article 3 – Offers and Agreements

• 3.1. All offers and quotations from Five Five Out are non-binding unless otherwise agreed in writing.
• 3.2. Five Five Out reserves the right to change prices and conditions of products and services on the Website without prior notice.
• 3.3. The Agreement between Five Five Out and the Customer is formed when the Customer places an order on the Website, and Five Five Out confirms this order.

Article 4 – Delivery

• 4.1. Five Five Out will make reasonable efforts to deliver orders within a reasonable period.
• 4.2. The Customer is responsible for providing accurate and complete shipping information. Any additional costs due to incorrect shipping information are the Customer’s responsibility.
• 4.3. The risk of loss or damage to products passes to the Customer upon delivery.

Article 5 – Payment

• 5.1. The Customer must make payment for the ordered products and services as indicated on the Website.
• 5.2. In case of non-timely payment, the Customer is in default, and Five Five Out is entitled to charge statutory interest and collection costs.

Article 6 – Right of Withdrawal (if applicable) 

• 6.1. The Customer has the right to withdraw from the Agreement within 14 days after receiving the products, unless the products are personalized or made to order.

Article 7 – Complaints

• 7.1. Complaints about products or services must be reported in writing to Five Five Out as soon as possible.
• 7.2. Five Five Out will respond to complaints within a reasonable time and will make efforts to resolve them to the Customer’s satisfaction.

Article 8 – Liability

• 8.1. Five Five Out is not liable for any direct or indirect damage resulting from the use of the Website, products, or services provided by Five Five Out.

Article 9 – Privacy

• 9.1. Five Five Out will process the personal data of the Customer in accordance with applicable privacy laws. See the privacy policy on the Website for more information.

Article 10 – Applicable Law and Disputes

• 10.1. Dutch law applies to these general terms and conditions and all Agreements between Five Five Out and the Customer.
• 10.2. Disputes between Five Five Out and the Customer will abide by the dutch law.
